These terms and conditions of the campaign "IKEA Furniture Buy-back" regulate the conditions and procedure for activities related to the used furniture, which has been purchased at IKEA and is returned by participants of the campaign in the manner and meeting the conditions specified in these terms and conditions. 


PLEASE NOTE THAT ANY ACTION RELATED TO THE RETURN OF USED IKEA PRODUCTS MUST FULLY AGREE WITH THESE TERMS.
 
1. General provisions
Terms and Conditions This document governing the conditions and procedure of activities related to the campaign "IKEA Furniture Buy-back."
Organiser or IKEA SIA Paul Mason Properties, registration number: 50103951541, address: Biķeru street 2, Dreiliņi, Stopiņu Municipality, is a legal entity established in accordance with the legislation of Latvia, organising this campaign. Customer service: +371 63301000 (on working days between 9 a.m. and 8 p.m., on weekends: between 9 a.m. and 6 p.m.).
Campaign The marketing campaign "IKEA Furniture Buy-back" established and conducted by the Organiser in the territory of Latvia in accordance with these terms and conditions, aimed at providing participants the opportunity to sell back to IKEA used IKEA furniture, in conformity with these terms and conditions.
Participant A private individual, who meets requirements set by the terms and conditions, who has full legal capacity and has reached the age of 18 (eighteen) years. Companies and legal entities are not permitted to participate in the Campaign.
Product  Furniture, which has been purchased at the IKEA store (the physical store or online) and in relation to which the Participant wants to return in accordance with these terms and conditions. Within the framework of this Campaign, furniture and products means a whole, assembled furniture (for example, chair, table, etc.) purchased by the Participant in an IKEA store and used only for personal purposes in a household.
List of Products The furniture, which may be submitted for the purpose of this Campaign:
•    wardrobes, cabinets, shoe storage, bed frames;
•    bookcases and shelves;
•    chairs and stools;
•    cabinets with drawers and chests of drawers;
•    dining tables, small tables and desks, sideboards etc.
The Product returned for the buy-back must be fully functional, clean, unmodified and fully assembled. Products not listed in this section cannot be transferred and returned to the Organiser for the purpose of this Campaign.

The furniture, which currently may not be submitted for the purpose of this Campaign: 
•    non-IKEA products; 
•    IKEA products which have not been in IKEA Latvia product range; 
•    home furnishing accessories;
•    textiles;
•    separate details and elements;
•    products that have been used outdoors;
•    mattresses and bedding (such as blankets, pillows, etc.);
•    kitchen products, including worktops, cabinets and fronts;
•    household appliances / electronics and lightning;
•    children products such as toys, bedding and mattresses;
•    food and plants;
•    large quantities of products;
•    items used for commercial purposes.
Assessment Activities carried out by IKEA unilaterally to determine the conformity of the Product with the terms and conditions of the Campaign.
IKEA Latvia store The location of carrying out the Campaign. Address: Biķeru street 2, Dreiliņi, Stopiņu Municipality.
Website www.IKEA.lv where the Organiser publishes the terms and conditions of the Campaign.

    
2. Purpose
2.1. Purpose of the Campaign
The purpose of the Campaign is to promote sustainable lifestyle, build a culture of re-usage of goods and enable customers to prolong the life of IKEA furniture.
 
3. Territory of the Campaign
3.1. The Organiser carries out the Campaign in the IKEA Latvia store in compliance with these terms and conditions.
 
4. Duration of the Campaign
4.1. The duration of the Campaign: 
  • Preliminary stage – submission of the Product application (via e-mail): from 3 June 2021 until 30 June 2021. 
  • Main stage – delivery of the Product (as agreed via e-mail in the direct communication with the Organiser): from 3 June 2021 until 14 July 2021.
4.2. The Participant has the right to take part in the Campaign by offering IKEA a product purchased at any IKEA store, which is or has been in the IKEA Latvia product range (since the day of the opening of the IKEA store in Latvia on 30 August 2018).
 
5. Conditions for participation in the Campaign
5.1. The Participant must meet the following requirements: 
  • Comply with these terms and conditions, has a full legal capacity and has reached the age of 18 (eighteen) years.
  • Carry out actual actions to take part in the Campaign by meeting these terms and conditions. 
5.2. Persons not meeting the requirements for participation in the Campaign may not be admitted by the Organiser to participate and/or can be excluded from the list of Participants.
 
6. Procedure for taking part in the Campaign
6.1. Preliminary stage: 
6.1.1. At the preliminary stage of the Campaign, the following actions shall be taken: 
6.1.1.1. The Participant shall apply for the Campaign with a Product, which meets requirements set by the terms and conditions, and during this stage (from 3 June 2021 until 30 June 2021) carrying out the following: 
  1. Send the Organiser an e-mail to atpirksana@IKEA.lv to apply for participation in the Campaign, providing the following information in the e-mail:
    • name of the Product;
    • 2–5 photos of the Product (recommended size per image: 1 MB).
  2. Ensure that the Product does not have either of the following:
    • stains and/or dirt;
    • defects that may affect functionality and/or safety of the Product;
    • damage, including but not limited to the following: deep scratches (more than 2 (two) cm long), surface deformation, jags, cracks on the surface and/or at the joints of parts, scuffs on any surfaces;
    • modifications, changes in functionality as well as changes in the Product design;
    • indications that the Product has been assembled not according to the assembly instructions.
  3. Ensure that Product is fully assembled according to the assembly instructions.
By sending the application e-mail, the Participant:
  1. Accepts and agrees with these terms and conditions, including on providing correct and reliable information. 
  2. Indicates in one application no more than 5 (five) Products. Submitting a larger number of Products is not allowed.
  3. May submit no more than 1 (one) application for participation in the Campaign every 24 (twenty four) hours. 
  4. Is not obliged to present the receipt for purchasing the Product.
6.1.1.2. After receiving the Participant’s information specified in Paragraph 6.1.1.1, the Organiser unilaterally assesses the Product and decides, if the Product passes the preliminary stage of the Campaign. If the Product passes this stage, the Organiser within 4 (four) working days shall send the response to the Participant via e-mail, indicating the amount of the proposed remuneration for the Product, and offer the Participant to return the Product to the IKEA Latvia store for resale in exchange for IKEA gift card. Thus for the purposes of this campaign the method payment is gift card.
6.1.2. If the Organiser declines the application and the Product does not pass the preliminary stage, the Organiser reserves the right not to send any message to the Participant. The Organiser shall not be responsible for the Participant's failure to receive information about an acceptance or a decline of the Product in the preliminary stage of the Campaign.

6.2. The main stage:
6.2.1. If the Participant receives a message from the Organiser about a positive result, the Participant is considered having passed the preliminary stage of the Campaign. The message from the Organiser shall include the following information:
•    Product/-s selected by the Organiser for participation in the Campaign.
•    Proposal for the preliminary value of the gift card (the offer is preliminary – the final value of remuneration shall be determined by the Organiser at the IKEA store upon the delivery of the Product, during the final Product evaluation in person, if the Organiser decides to accept the Product). At this stage, the Organiser shall have the right to decline the Product, despite the previous e-mail message, if the Product does not meet the terms and conditions of the Campaign.
6.2.2. The Participant has the right no later than 14 (fourteen) calendar days from the date of receipt of acceptance by the Organiser to deliver the Product, which was approved by the Organiser during the preliminary stage, to the IKEA Store and transfer it to the Organiser. At this stage, the particular Product must be:
•    assembled and meet requirements defined in these terms and conditions; 
•    of good quality and appropriate quantity – specified in Paragraph 6.1.1.1. of these terms and conditions;
•    complete – the completeness of the Product must fully comply with the Product assembling instructions.
6.2.3. Within 1 (one) day the Participant is permitted to deliver to the IKEA store and transfer to the Organiser no more than 5 (five) Products, which have been approved for participation in the Campaign. Delivering and/or transferring more than 5 Products is not allowed.
6.2.4. Upon delivery/transfer of the Product to the Organiser, the Participant shall provide the following:
1) the approved Product;
2) the application number indicated in the approval e-mail sent by the Organiser.
6.2.5. After the transfer of the Product to the Organiser, the Organiser compares the information about the Product, provided by the Participant during the preliminary stage with the actual Product and quality of the Product delivered to the IKEA store. On the grounds of the information provided by the Participant during the preliminary stage and the main stage, the Organiser has the right to take a final decision on acceptance/decline of the Products and, in the case of accepting the Product, exchange it for an IKEA gift card in the amount not exceeding 40% of the selling price of the Product at the IKEA Latvia store on the day the Organiser assessed the Participant’s application (the value of the gift card depends on the quality of the Product set by these terms and conditions). If, at the moment of assessing the Participant’s application, the Product applied for the Campaign is not in IKEA Latvia range, the maximum 40% of the value of the Products shall be set according to the price, which was valid on the last day the Product was available at the IKEA Latvia store. The moment the Organiser accepts the Product from the Participant, ownership of the Product transfers from the Participant to the Organiser. 
6.2.6. The gift card granted in exchange for the approved Product is valid only in the IKEA Latvia store. The IKEA gift card is not valid for online purchases. The validity period of the gift card is 12 (twelve) months from the date of issue. If the IKEA gift card has not been used within the validity period, the value of the gift card cannot be transferred, replaced and/or cashed. The gift card cannot be restored even in the case of loss; it will not be issued again. The gift card cannot be cashed and/or exchanged for other products. If the Participant is unable to receive IKEA gift card or if the Participant cannot use the gift card due to reasons beyond the control of the Organiser, no compensation shall be paid to the Participant.
These rules are valid complimentary to the general rules on IKEA gift cards posted on the website www.IKEA.lv. In the event of a conflict between these terms and conditions and the general terms and conditions on the usage of IKEA gift cards posted on website www.IKEA.lv, the terms and conditions of the Campaign shall prevail. 
6.2.7. The Organiser is considered to have fulfilled the obligation to issue the IKEA gift card at the moment of signing the acceptance certificate between the Organiser and the Participant.

6.3. During the period of the Campaign specified in these terms and conditions, the Organiser has the right to do the following:
6.3.1. Refuse the Product and not to issue a gift card, in the absence and/or non-compliance of the Products with the requirements set by these terms and conditions.
6.3.2. Decide unilaterally on acceptance or decline of the Participant’s Product without explanation.
6.3.3. If needed, request the Participant additional information on the Product, after passing the preliminary stage.
6.3.4. To exclude the Participant from participation in the Campaign and/or decline the Product and not to issue a gift card in case of factors indicating a direct and/or indirect violation of these terms and conditions.
6.3.5. From the moment of receipt of the Product from the Participant the Organiser may use Products at its sole discretion.
6.3.6. Within the framework of the Campaign the Product received from Participant is given an opportunity of a second life, namely, it will be sold at the IKEA Latvia store in the reduced-price department. In order to carry out the reselling process the value added tax will be added to the resell price.
 
7. Final provisions
7.1. Participant of the Campaign is required to comply with these terms and conditions.
7.2. Information about the Campaign and the terms and conditions are posted on www.IKEA.lv. The Organiser reserves the right to post additional Campaign information on the website. The Organiser reserves the right to amend these terms and conditions by posting a revised version of the terms and conditions on the website; such changes come into force from the date of posting the relevant information on the website. In order to ensure that the Participant receives the most up to date version of the terms and conditions, including a revised version, the Participant undertakes to check the website for information about the changes and additions to these terms and conditions at least once every 5 (five) days.
7.3. The Organiser has the right to terminate the Campaign before the set deadline without compensation.
7.4. The Organiser shall process personal data of the Participant for the purpose of organising, executing and administering the Campaign. Data processed for this purpose: e-mail address. For more details about how IKEA processes personal data for this purpose, for how long such data, contact details and other information is retained see Paragraph 1.7 of the IKEA Privacy policy (https://www.ikea.lv/en/privacy-policy#1-7).
7.5. The Organiser reserves the right not to enter into written negotiations or other contacts with the Participant, except for the cases set by these terms and conditions.
7.6. The Organiser is not responsible for errors/failures during transmitting data via the Internet as a result of technical problems and/or fraud on the Internet, as well as for other reasons beyond the control of the Organiser.
7.7. The Organiser bears the costs directly specified in these terms and conditions. All other expenses associated with participation in the Campaign (delivery of products etc.) shall be borne by the Participant and settled at the Participant’s own expense.
7.8. The terms and conditions have been drawn up in 3 languages. In the case of disputes, discrepancies and uncertainties, the Latvian version shall prevail.
